IRS Extends Comment Period for Native American Welfare Exclusion Guidance

The Internal Revenue Service has extended the comment period for Notice 2011-94, which will apply the general welfare exclusion to Indian tribal programs that provide benefits to tribal members.  The new comment period ends March 14, 2012. 


The IRS is seeking input on how the exclusions should apply to housing, cultural education and elder programs.  Some examples of the programs which may fall under the exclusion include:

  • Programs which provide housing both on and off the reservation, but with income limits different from those of the Department of Housing and Urban Development
  • Programs involving tours of sites that are historically significant to a tribe
  • Language preservation programs
  • Community recreational programs
  • Programs that provide cultural and social events for tribal members
  • Educational programs providing tutors or supplies to primary and secondary school students
  • Job retraining programs for adults, and
  • Programs providing services to elders such as heating assistance or meals.
